Understanding Child Support Laws: A Comprehensive Guide

Child support is a crucial element in ensuring the wellbeing of children. Child support laws are governed by the Child Support (Assessment) Act 1989, which sets out the legal framework for assessing and collecting child support payments.

Both parents have a legal obligation to financially support their children until they turn 18 years old, or until they finish their secondary education, whichever comes later. The amount of child support payable is based on a formula that takes into account the income of each parent, the number of children, and the amount of time the children spend with each parent.

Parents can choose to reach a private agreement on child support, but it must be in line with the formula set out in the Child Support (Assessment) Act 1989. If parents cannot agree on child support arrangements, they can apply to the Department of Human Services for a child support assessment. The assessment is based on information provided by both parents, and takes into account factors such as income, expenses, and parenting arrangements.

In some cases, a parent may not meet their child support obligations. In such situations, the other parent can seek enforcement action through the Department of Human Services, which can include wage garnishment, property seisure, or legal action.
